• Owner liable for "free to a good home" items which were later dumped by

A householder put some unwanted furniture outside his house (not sure
whether it was on his own drive or on the street) with a sign "free to
take". The items were later found dumped elsewhere.

The householder was prosecuted for "failing in his duty of care", even
though he didn't dump them - it was whoever took them who did that.

How is it right that someone can be prosecuted for something that *they*
didn't do, and which someone else did after they took the items.
