WBFF (Baltimore, MD) � The 15-year-old arrested alongside Montaz Bailey,
18, in the attack on a 66-year-old man in Upper Fells Point on September
26 will now also be charged as an adult with attempted first degree
murder, according to the Baltimore City State�s Attorney�s Office.
In a statement, Baltimore City State�s Attorney Ivan Bates wrote that
while he didn�t make this decision lightly, the gravity of the crime and
threat to public safety required his Office to act.
�The one thing I want to be crystal clear: in Baltimore City if you're
going to stomp on an individual's head you can expect to be charged with attempted murder,� said Bates, outside the courthouse.
�We think that type of behavior is heinous, vicious and violent and we
will not stand for that. We will hold individuals accountable who do that
to residents in Baltimore City,� added the City State�s Attorney.
Bailey is facing 15 criminal counts including attempted murder and armed robbery, as well as conspiracy and gun-related charges.
In newly obtained court documents, Bailey is described as the suspect
�wearing blue jeans, a black hoodie, and a black mask.�
In a doorbell video from the scene the individual matching that
description is seen stomping on the victim�s head.
The victim later spoke with FOX45 News.
�As I was running I was yelling �help, help I�m being robbed,� said the
victim who only wanted to be identified as Bernie.
�He pulled the gun out and he stuck the gun in my face and I said what do
you want and he said I want everything,� he added, describing the crime.
Officials are not identifying the 15-year-old suspect due to his age.
In court documents he�s described as wearing a gray hoodie and black sweatpants.
When asked for specifics on who stopped the victim in the head in the
video, Bates explained why both teens are now facing the attempted first
degree murder charge.
�One of the things we talk about is conspiracy. They're working in concert together. When we look at the law, and I don't make the law, but what the
law says is what one does, all are responsible. We will also look to hold everybody accountable,� said Bates.
FOX45 News questioned BPD about the third suspect in the video, and
whether any additional arrests have been made.
A spokesperson would only say the investigation is ongoing.
As officials piece together the case, new details are being uncovered
about Bailey and his criminal past.
A judge denied Bailey bond during his bail review inside Baltimore City District Court Tuesday.
During the hearing, officials detailed Bailey had a criminal record as a juvenile.
Public court records indicate Bailey was already wanted by police at the
time of this attempted murder in Upper Fells Point.
Charging documents obtained by FOX45 News detail back in July 2024 Bailey
was found asleep in the driver�s seat of a stolen van in Baltimore County.
He was one of four people inside the vehicle, which had been reported
stolen out of the City, according to court documents.
Bailey was arrested and charged and later released on his own
recognizance.
But records show on August 26 Bailey failed to appear in court, and a
warrant was issued for his arrest.
Fast forward four weeks, Bailey is now accused in the attempted murder of
the 66-year-old man.
Bailey is due back in court on October 24.
Officials are not identifying the 15-year-old due to his age. He should
have his bond hearing this week.
