DAY 5 - Witnesses will continue to testify. First witness to
take the stand is Erika Patterson, Brooks ex-girlfriend.
8:33 a.m. Judge Dorow starts by addressing concerns that Darrell
Brooks had the previous day about the juror. He believed to
recognize one of them and said that juror "flipped him off".
Juror number 41 was brought out and questioned if at any point
in time she was ever at the initial appearance for Mr. Brooks.
She told the court she wasn't there, and for the record, the
finding was that number 41 was not at Brook's initial
appearance, and is not the person who made an inappropriate
gesture to Brooks either at or following that hearing.
9:10 a.m. Erika Patterson, Brooks ex-girlfriend and mother of
their child, is the first witness to take the stand today.
Patterson testified to knowing Brooks since she was 15 years
old. She met him in Nevada and came with him to Milwaukee then
moved to Waukesha.
Patterson confirmed she came into contact with Darrell Brooks on
November 21, 2021. That she was struck by Brooks and police were
called. This was right before the parade incident.
9:30 a.m. Brooks cross-examines Patterson. "First of all, good
morning. Good morning. Happy birthday," said Brooks.
10:16 a.m. Detective Steven Guth takes the stand. Detective Guth
met with Erika Patterson the day after she reported a domestic-
related incident and clarify her statement.
"As part of that clarification, did you get into a squad car
with Miss Patterson and what was the point of doing that? asked,
Assistant District Attorney Zach Wittchow.
"I wanted to ride in the car with her since she [Erika
Patterson] was unfamiliar with the geography of the city. And so
that she could point out to me in specific directions on where
she went with Mr. Brooks," responded Guth.
10:49 a.m. Fifteen-minute recess.
11:07 Judge resumes the trial saying that she was informed that
Brooks COVID results had been given to him earlier this morning
and asks Darrell Brooks to open the envelope.
Brooks refuses to open the envelope.
11:09 a.m. Judge Dorow clears the courtroom.
"We're going to go off the record. And we're going to find that
piece of paper and I'm going to address it when that's done,"
said Dorow.
11:25 a.m. Darrell Brooks COVID test results are negative
11:30 a.m. Judge calls for a 90-minute lunch break.
1:05 p.m. Court is back in session
The state calls Waukesha Police Officer Jeremy Phillips, Officer
who was called to respond to fighting in Frame Park.
1:58 p.m. Witness Kyle Edwards takes the stand.
Edwards says he encountered a red SUV driving on the wrong side
of the street while driving toward the Waukesha Christmas parade.
The driver of the SUV rolled down his window and asked Edwards
why he didn't get out of his way. Edwards explained to that SUV
driver that the street was one-way and he was going down the
wrong way.
Edwards identified Darrell Brooks as the driver of the red SUV.
2:30 p.m. Holly Berg is called as the next civilian witness.
Berg says she saw the red SUV going really fast and run into the
group of people right in front of her.
"I saw directly through the driver's window. I saw a man focused
on the group ahead of him," said Berg. She identified the driver
as Darrell Brooks.
3:00 p.m. Afternoon break is announced
3:15 p.m. Court resumes.
"Mr. Brooks, you have incredible hearing because you are right.
At approximately 2:58 to 2:59 n that video, I can hear Erica
Patterson saying that I get into an argument or I argue with my
baby daddy all the time and he previously ran over my foot. So
I'm going to take the request under advisement at this point I'm
inclined to strike this exhibit from the state's case," said
Judge Dorow.

3:20 p.m. Next witness is Detective Casey who was assigned to
the Christmas parade as traffic control and claims to have
patrolled the Christmas parade for many years.

Brooks is accused of driving his SUV into the crowd at the
Waukesha Christmas Parade, killing six people and injuring more
than 60.
Brooks, who will represent himself in court, faces 77 counts,
including six counts of first-degree intentional homicide, 61
counts of recklessly endangering safety, six counts of hit-and-
and-run involving death, two counts of felony bail jumping and
two counts of battery.
On Nov. 21, 2021, Brooks was allegedly fleeing the scene of a
fight near White Rock School.
He broke through a police barricade and drove onto the parade
route, investigators said.
One officer fired three shots at Brooks' SUV in an attempt to
get him to stop.
"As I continued to watch the SUV, it continued to drive in a zig-
zag motion. It was like the SUV was trying to avoid vehicles,
not people. There was no attempt made by the vehicle to stop,
much less slow down," one witness told police, according to a
criminal complaint.
Police caught up with him less than a mile from the scene after
he allegedly ditched his battered SUV.
He was arrested without incident.
The six people killed were 8-year-old Jackson Sparks, 52-year-
old Jane Kulich, 52-year-old Tamara Durand, 71-year-old Leanna
Owen, 79-year-old Virginia Sorenson, and 81-year-old Wilhelm
Hospel.
Duran, Owen and Sorenson were members of the Milwaukee Dancing
Grannies.

In June, Brooks changed his plea to not guilty by reason of
mental defect, but withdrew the insanity plea last month,
changing it to not guilty.
Brooks is facing life in prison if convicted of intentional
homicide.
