• Double jeopardy to be considered at Supreme Court!

    The United States Supreme Court has granted review in Barrett v. United
    States.

    Dwayne Barrett was convicted under the Hobbes Act 18 U.S.C. Sec. 924,
    an act which allows there to be federal jurisdiction to prosecute a robbery.
    He was convicted under two different provisions of the statute, section
    924(c) aiding the use of a gun, and section 924(j), aiding the use of a
    gun used in homicide.

    He doesn't want to be sentenced under both provisions, making a double
    jeopardy argument. Instead he wants 924(c) to be considered a lesser
    included offense in sentencing and not an additional offense.
