Earlier today I posted on this. I have now found some analysis of the
ACT Bill that gives some clarity:

However I believe that this is still a storm-in-a-teacup given it will
not ever be passed into law. Maori in particular should pipe down and
starve ACT from the publicity they are getting from this. Submit to
the Bill if you must (though why anyone would bother is illogical). It
seems totally impossible that any results of Select Committee
submissions will cause National to renege on their commitment to vote
this Bill down on its second reading.
