Quite a few years ago, I filed an eviction action in a Florida
county. The Sheriff at that time was not too diligent (or bright)
and after 3+ weeks, he had not delivered or posted the summons. I
called him on the phone to politely inquire why the summons had
not been delivered. He told me he wasn't worried about it.
Finally, I had to go over his head to get responsible action.
Fast forward to today. A different Sheriff. About a week and a
half ago, I filed another eviction. So far, no delivery or
posting.
I'm wondering about the standards of conduct for Florida sheriffs
regarding delivering a summons. What goes for acceptable conduct
in this area?
I've run into the same issue in California. Sheriffs have more
important things to do, so serving process is low down on their
priority list. If you want quicker action, especially for an
eviction, get a private process server.
