How to become a first offender

When courts give some special favorable treatment like the quote below
to first offenders, are they generally referring to first offenders
within ttheir own state, or first offenders within the United States? Or
within the judicially honest world?
If it's only their own state, that lets someone move 49 times to a new
state and be a first offender wherever he goes. That doesn't seem
right.
"NYTimes Ms. Powell was prosecuted under the Georgia First Offender Act,
which allows people with no prior felonies to avoid having the
conviction on their permanent record if they comply with the terms of
their sentence. Ms. Young, the prosecutor, noted in court that if Ms.
Powell successfully complies with her sentence, she can then �honestly
say� that she has �never been convicted of these charges.�"
In her case, a very good chance she's never been charged with a crime
before anywhere in the world.
