The Eighth does not mention male, female, whatever. It says no
person regardless of your criteria can be subject to cruel or
unusual punishment.
So you admit that the 8th does not permit the state to force men and
women to use the same bathrooms as trans people. This is progress
for you!
The eighth amendment has nothing to do with toilets. It pertains only to criminal defendants and convicts. It has no applicability to whether or not transsexuals are allowed to use the toilet facilities for the gender with which they identify — no applicability whatsoever.
If trans women are allowed to use women's toilets and locker rooms, non-trans women are not being punished by the criminal justice system. The eighth amendment simply does not apply.
