under Debian/SELinux (2.6.7 kernel):

i found that with selinux enforcing=0, i had no problem with devpts.

i found that with selinux enforcing=1 i DID have a problem.

by re-running /etc/init.d/mountvirtfs (from udev just like in udev stop)
the problem went away.
