That Marrion Baker mentioned his encounter with Oswald in his affidavit of 11/22.
Baker never identifies Oswald as the man he encountered.
He gives a description of a man that does not match Oswald
and says that Roy Truly identified him as an employee.
He described the man he saw as a white male, 30 years old, 5'9", 165 lbs., >dark hair and wearing a light brown jacket. He said he encountered him on either the third or
fourth floor.

In fact, Baker's affidavit was given after 3pm, at a time when Oswald was already in custody
and police had possession of the Tippit murderer's "tan" jacket. ( 24 H 307 )

The identification of Oswald is Von Pein's, not on Baker's affidavit, and he gets spanked for it.
