    [37] Le Tribunal estime quil en serait ainsi sil devait
    absoudre inconditionnellement les accusis puisque quils ont
    dicidi de mettre en place une culture de cannabis en dipit
    de la loi. M. Brunet a fait la preuve quil connant bien
    toutes les exigences de la loi et les conditions dobtention
    dun permis.

    [37] The Court it would be so if it unconditionally
    discharged the accused since they did decide to set up a
    cannabis grow despite the law. Mr. Brunet testified he knew
    well all the requirements of the law and the conditions to
    obtain a permit.

    graviti objective trhs grande, leur plaidoyer de culpabiliti
    et la reconnaissance de leur tort ainsi que labsence de
    casier judiciaire, sont tous des iliments qui doivent jtre

    the absence of criminal record, are all elements that must
    be taken into consideration.

    that they knowingly violated the law and that the Court must
    impose a just and proportional sentence.

    JCT: No matter how much they needed their medicine, they
    should have waited the many months until Health Canada had
    processed their permit. No matter desperately she needed her
    medicine, she should have waited.

    [41] Il y a lieu de distinguer la responsabiliti de Monsieur
    Brunet qui est plus grande que celle de Madame Pilon qui
    sest assuriment fait manipuler. Ce dernier savait ce quil
    faisait ayant lui-mjme obtenu dans le passi un permis pour
    la culture de cannabis pour son propre usage. Cest lui qui a
    mis en place la culture chez Mme Pilon.

    [41] The responsibility of Mr. Brunet must be distinguished
    as greater than that of Madame Pilon who was surely
    manipulated. He knew what he was doing since he had himself
    obtained for his own use. He set up the grow up at Madame
    Pilon's residence.

    JCT: No matter how desperately she needed her medication, he
    should have let her suffer until Health Canada processed her
    permit.

    [42] Dans les circonstances, le Tribunal estime quimposer un
    casier judiciaire ` lun ou ` lautre leur nuirait et ne
    desservirait pas les fins de la justice, en revanche,
    prononcer une absolution inconditionnellement
    diconsidirerait limage de la justice.

    [42] In the circumstances, the Court considers that imposing
    a criminal record to one of the other would be injurious and
    would not serve the interests of justice, in opposition,
    granting an unconditional discharge would harm the image of
    justice.

    [43] Cest ainsi quune peine doit jtre imposie tant ` Mme
    Pilon qu` Monsieur Brunet pour dinoncer leur comportement
    illigal, dissuader dautres personnes de suivre leur exemple
    et ne pas nuire ` limage de la justice.

    [43] Therefore, a sentence must be imposed on Madame Pilon
    as well as on Mr. Brunet to condemn their illegal activity,
    to dissuade others from following their example and not harm
    the image of justice.

    12 mois ` compter du 15 octobre 2022 et respecter les modalitis
    dexicution par un agent de probation ou tout autre intervenant
    disigni par celui-ci;
    - Se prisenter ` lagent dici au 15 octobre 2022;
    - Verser la somme de 1 000 $, au Regroupement des maisons pour
    femmes victimes de violence conjugale dici 12 mois, ` compter de ce
    jour, le chhque devant jtre diposi au greffe de la Cour et libelli `
    lordre du Ministhre des Finances;
    - Signer sans dilai la prisente ordonnance.

    [46] Absolves Madame Gisele Pilon upon the following
    conditions:
    - Perform 100 hours of community service in the 12 months
    from October 15 2022 and obey the requirements of the
    probation officer or other person designated by him;
    - See the probation officer before October 15 2022;
    - Contribute $1,000 to the Womens' Shelter within the next
    12 months, the check being submitted to the clerk of the
    Court made out to the Minister of Finance;
    - Sign the present Order without delay.

    [47] En ce qui concerne MONSIEUR RAYMOND BRUNET, LE TRIBUNAL :

    [47] As to Mr. Raymong Brunet, the Court:

    [48] ABSOUT Monsieur Raymond Brunet aux conditions
    suivantes:
    - Effectuer 200 heures de travaux communautaires dans un
    dilai de 12 mois ` compter du 15 octobre 2022 et respecter
    les modalitis dexicution par un agent de probation ou tout
    autre intervenant disigni par celui-ci;
    - Se prisenter ` lagent dici au 15 octobre 2022;
    - Verser la somme de 2 000 $, au Regroupement des maisons
    pour femmes victimes de violence conjugale dici 12 mois, `
    compter de ce jour, le chhque devant jtre diposi au greffe
    de la Cour et libelli ` lordre du Ministhre des Finances;
    - Signer sans dilai la prisente ordonnance.

    [48] Absolves Mr. Raymond Brunet upon the following
    conditions:

    JCT: So Gisele established medical need 7 months before
    Health Canada hopped-to-it to deliver her permit, she would
    have never have been busted but for Health Canada delay in
    processing her permit, and Judge Charbonneau smashes them
    with the harshest sentence imaginable.

    300 hours of community service is over 7 weeks of unpaid
    work. As well as not returning their $20,000 in equipment,
    she hits them with $3,000 in fines. Sure, she didn't give
    them criminal records to cause them to lose their permits
    but when the Crown told her they had not obeyed her order to
    drop the seizure of the house until the community service
    was done and the fines paid, she acquiesced. If the Crown
    wasn't going to obey her order, what could she do? As if
    having the Crown say "we're not obeying your order until we
    feel like it" doesn't bring the administration of justice
    into disrepute!

    But despite the harshest most unjust sentence possible for
    morally innocent accuseds, they are happy to come out of it
    without a criminal record and no house seizure.

    And Health Canada gets away with hurting another patient.

    Nearing the end of the cannabis prohibition era and doesn't
    Canadian Justice stink?
